By accessing or using Merch's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Description of Service

Merch provides a platform that enables users to create, preview, and sell custom merchandise featuring their artwork and designs. Our services include mockup generation, product fulfillment, and e-commerce tools.

User Accounts

When you create an account with us, you must provide accurate and complete information. You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

Intellectual Property

You retain ownership of any artwork or designs you upload to Merch. By uploading content, you grant us a license to:

• Display and process your content to provide our services
• Generate product mockups featuring your designs
• Fulfill orders containing your designs

You represent and warrant that you have the right to use and license any content you upload and that it does not infringe on any third party's intellectual property rights.

Prohibited Content

You may not upload or sell products featuring content that:

• Infringes on copyrights, trademarks, or other intellectual property
• Is defamatory, obscene, or offensive
• Promotes violence, discrimination, or illegal activities
• Contains personal information of others without consent
• Violates any applicable laws or regulations

Orders and Payments

All orders are subject to acceptance and availability. Prices are subject to change without notice. We reserve the right to refuse or cancel any order for any reason, including suspected fraud or violation of these terms.

Shipping and Returns

Products are printed on demand and shipped by our fulfillment partners. Shipping times vary by location. Due to the custom nature of our products, we generally do not accept returns unless the product is defective or damaged during shipping.

Limitation of Liability

To the maximum extent permitted by law, Merch shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Merch and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these terms.

Termination

We may terminate or suspend your account and access to our services at any time, without prior notice, for conduct that we believe violates these terms or is harmful to other users, us, or third parties.

We reserve the right to modify these terms at any time. We will notify users of significant changes by posting a notice on our website. Your continued use of our services after such changes constitutes acceptance of the new terms.
